This website is owned and operated by Jenni Shoesmith. These Terms set forth the terms and conditions under which you may use the website and services as offered. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

Buying from the site:

When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.  Artwork will be shipped only when a payment has been made in full.  If payment has not been paid in full within 7 days I will consider the transaction cancelled and put the artwork up for sale. 

The prices I charge for my paintings and prints are listed on the website. I reserve the right to change my prices for artwork displayed at any time and to correct pricing errors that may inadvertently occur. 

My prices are in New Zealand dollars, please check your currency exchange rate before purchasing.

GST (New Zealand Goods and Services Tax Act 1985) will be included in the prices displayed on this website. 

 

Colours:

I cannot guarantee that the colours shown on your monitor are accurate to the exact colours of the artwork you are purchasing, as each monitor is calibrated differently.  Colours are represented on the site as accurately as possible.

Intellectual property and copyright:

As the artist and creator of the works shown on this site, I am the sole owner/licensee of the intellectual property rights on all artwork content/elements of this site, gallery, and online shop, thereby, including, without limitation, images, text, graphics, logos, copyrights, photographs, videos, and all Intellectual Property Rights related thereto, are the exclusive property of Jenni Shoesmith. As a user and customer of this site you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publish, adapt, edit or create derivative works thereof, nor permit any person to do so without our prior written consent.

Shipping:

I am not liable or responsible for incorrect addresses or information put into this site, nor for any damage that occurs to the artwork in transit.  The artwork will be packaged securely to keep the artwork as protected as possible and will be tracked via a dependable courier service. Tracking numbers and any additional important shipping information will be sent to you in an acceptable time frame once an order has been placed. I am not responsible for any late deliveries once the artwork has been placed with the courier. Please see the shipping information.

I will not be able to ship to PO boxes.

You, the customer, are responsible for any taxes, duties, or fees in accordance with the country you live in when receiving your artwork.

Modification of Terms:

I reserve the right to modify these terms from time to time at my sole discretion.  When I change the Terms in a material way, I will notify you, the customer, that changes have been made to the Terms. Your continued use of the Website after any such change constitutes your acceptance of the new Terms.
